WILL OF JOHN GRAVATT, SENIOR OF WINDMILL STREET, FINSBURY SQUARE, MIDDX, GENTLEMAN

This is the last Will and Testament of me John Gravatt of Windmill Street Finsbury Square in the County of Middlesex, Gentleman.   First I direct all my just debts and Testamentary Expenses to be paid and I give and bequeath unto my Granddaughter Mary Gravatt she having attained the age of twenty one years the sum of Fifty pounds Sterling.  And to my Sister Nanny Horn [Ann] of Thames Street the sum of Fifteen pounds Sterling.  And to my Nieces Sophia Horn and Hannah Horn of Thames Street aforesaid the sum of five pounds Sterling each all which Legacies I direct my Executrix and Executor hereinafter named to pay within one Month after my decease.  I also give as a mark of my respect to my said Executrix and Executor and my Niece Mrs Battice of Doncaster Place, Old Kent Road, Widow a Gold Mourning Ring each.   And I give devise and bequeath all the rest and residue of my real and personal Estate and Effects of what nature or kind soever (after the payment aforesaid) whereof I shall die possessed unto my Daughter in Law Hannah Gravatt of Windmill Street aforesaid News vendor and Robert Williams of Windmill Street aforesaid Baker and the survivor of them and Executors or Administrators of such Survivor Upon trust to get in and convert into Money all my said Estate and Effects which shall not consist of Money in the Public Funds and to lay out and invest such part thereof if any shall remain after payment of my said debts Funeral and Testamentary Expenses and Legacies hereinbefore given upon Government Securities and to stand possessed of such Securities and all other my Estate and Effects and the Dividends interest and annual proceeds thereof upon trust. 

In the first place to pay the whole of the said Dividends interest and annual proceeds to my said Daughter in Law Hannah Gravatt or permit her to receive the same (subject to the Legacies hereinafter mentioned) during the term of her natural life and for her own use and benefit and I devise may said Trustees or the survivor of them to pay unto my Grand Children Thomas Gravatt, Robert Gravatt, James Gravatt, Hannah Gravatt and Mira Sarah Gravatt the sum of Fifty pounds Sterling each upon this or either of their attaining the age of Twenty one years but should either of them die before attaining the said age I desire the said legacy to devolve into and form part of my residuary Estate and I give and bequeath unto my Daughter in Law Sarah Barnesof Pentonville the sum of Ten Pounds Sterling to be paid to her within one month after my decease and after the decease of my said Daughter in Law Hannah Gravatt I give and bequeath the principal of such Stocks and securities and all other the residue of my said Estate and Effects of what nature or kind soever equally unto between and amongst my said Grand Children Thomas Gravatt, Robert Gravatt, James Gravatt, Mary Gravatt, Hannah Gravatt and Mira Sarah Gravatt or such of them as shall be living at the decease of my said Daughter in Law Hannah Gravatt and to the Child or Children of either of them who shall have previously died such Child or Children taking their parents share only such shares to be paid and payable when and as they shall respectively attain the age of twenty one years provided always and I hereby declare that in case either of them the said Hannah Gravatt (my Daughter in Law) or Robert Williams or any Trustee or Trustees to be appointed by virtue hereof shall die or refuse or become incapable to act in the execution of the trusts herein contained before the same shall have been only executed that it shall be lawful for my said Daughter in Law Hannah Gravatt during her life and after her decease for such of my said Grandchildren as shall have attained the age of Twenty one years by any writing under his, her or their hands to appoint any other person or persons to act in the execution of the said trusts in the stead of the Trustee or Trustees so dying declining or becoming incapable to act as aforesaid either jointly with the surviving or the continuing Trustee or solely as occasion may require and I do hereby declare that the Trustees hereby appointed and the Trustee or Trustees to be from time to time appointed under the provision lastly hereinbefore contained their respective heirs Executors or Administrators shall be chargeable only for such monies as he, she or they shall actually receive under or by virtue of the Trusts hereby in him her or them reposed and that they or any of them shall not be accountable the one for the other or others of them but each of them only for his or her own individual acts neglects or defaults.  And I do hereby appoint my said Daughter in Law Hannah Gravatt and the said Robert Williams Executrix and Executor of this my will and hereby revoking all former and other Wills by me at any time heretofore made do declare this to be and contain my last Will and Testament In Witness whereof I the said John Gravatt have hereunto set my hand and seal this Eleventh day of January, one thousand, eight hundred and thirty four John Gravatt (Seal).  Signed Sealed and delivered and published by the said Testator as and for his Last Will and testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as Witnesses C. J. Jenkinson, 1 Bond Court, Walbrook, Solr Saml S. Clapham 14 East Road City Road Gentleman.

PROBATE dated 17 January 1834

The Will of John Gravatt late of No. 8 Windmill Street Finsbury Square in the County of Middlesex Gentleman deceased was proved at London on the Seventeenth day of January one thousand eight hundred and thirty four before the worshipful John Danberry Doctor of Laws and Surrogate by the Oaths of Hannah Gravatt Widow and Robert Williams the Executors to whom Administration was granted having been first Sworn duly to Administer.
